1. DEFINITIONS & INTERPRETATION

In these Terms & Conditions, the following terms shall have the meanings assigned to them below:

Term Definition
“Company” Shree Moji Foundation Micro Finance Private Limited, a company registered under the Companies Act, 2013, with its registered office in Rajasthan, India
“Platform” The Company’s website at https://shreemojifoundation.com, its mobile application, and all associated digital services
“Investor” Any individual, HUF, or entity that registers on the Platform and invests in any investment plan offered by the Company
“Investment Plan” Any structured micro finance investment product offered by the Company with defined terms, return rates, and payout schedules
“KYC” Know Your Customer — the identity and address verification process mandated under Indian financial regulations
“Returns” The fixed income or profit earned by an Investor on their invested principal as per the terms of the chosen Investment Plan
“Account” The registered investor account created on the Platform upon successful KYC verification
“Services” All financial products, advisory services, consultation services, fundraising assistance, and portfolio reporting services offered by the Company
“NRI” Non-Resident Indian investor as defined under FEMA, 1999
“we / us / our” Shree Moji Foundation Micro Finance Private Limited
“you / your” The Investor, user, or visitor accessing the Platform

The Company operates as a micro finance institution in compliance with applicable Reserve Bank of India (RBI) regulations, the Companies Act, 2013, and all other relevant Indian financial laws and guidelines.


3. ACCEPTANCE OF TERMS

3.1 Agreement to Terms

By accessing our Platform, registering an investor account, or using any of our Services, you confirm that:

  • You are at least 18 years of age
  • You are legally competent to enter into a binding contract under Indian law
  • All information you provide is accurate, complete, and truthful
  • You have read and understood these Terms & Conditions in their entirety
  • You agree to comply with all applicable Indian laws and regulations

3.2 Updates to Terms

Shree Moji Foundation reserves the right to modify these Terms & Conditions at any time. Updated terms will be posted on our Platform with a revised “Last Updated” date. Your continued use of the Platform after any update constitutes your acceptance of the revised terms. We recommend reviewing these terms periodically.

3.3 Supplementary Policies

These Terms & Conditions must be read in conjunction with our:

  • Privacy Policy
  • Investment Plan Agreement (specific to each plan)
  • KYC & AML Policy
  • Grievance Redressal Policy
  • Cookie Policy
  • Refund & Withdrawal Policy

In the event of any conflict between these Terms & Conditions and a specific Investment Plan Agreement, the Investment Plan Agreement shall prevail in respect of that specific plan.


4. ELIGIBILITY CRITERIA

4.1 Individual Investors

To register and invest on our Platform, individual investors must meet the following criteria:

  • Be a citizen of India or an eligible NRI as defined under FEMA, 1999
  • Be at least 18 years of age at the time of registration
  • Possess a valid Aadhaar card and PAN card
  • Hold an active Indian bank account (savings or current)
  • Not be declared insolvent or under any legal order restricting financial transactions
  • Not be a politically exposed person (PEP) unless additional compliance requirements are met

4.2 NRI Investors

Non-Resident Indian investors must additionally:

  • Hold a valid Indian passport
  • Possess an active NRE or NRO bank account in India
  • Comply with all FEMA and RBI regulations applicable to NRI investments
  • Submit required overseas address proof and FATCA declaration

4.3 Business Entities

Companies, trusts, partnership firms, and HUFs seeking to invest or use our fundraising services must:

  • Be legally registered and in good standing under applicable Indian law
  • Provide authorised signatory documentation and board resolution
  • Complete entity-level KYC as per RBI guidelines
  • Comply with all applicable corporate compliance requirements

4.4 Disqualification

The Company reserves the right to refuse registration or terminate any account if an applicant or investor is found to be ineligible, has provided false information, or is subject to any legal, regulatory, or court-ordered restriction on financial transactions.


5. ACCOUNT REGISTRATION & KYC

5.1 Registration Process

To create an investor account on our Platform, you must:

  • Provide accurate personal information including your full legal name, date of birth, contact details, and address
  • Submit valid KYC documents as specified by the Company
  • Complete Aadhaar-based e-KYC or in-person KYC verification
  • Set up a secure password and enable multi-factor authentication
  • Link a verified Indian bank account for investment and payout transactions

5.2 KYC Requirements

The following documents are mandatory for KYC verification:

Identity Proof (any one):

  • Aadhaar Card
  • PAN Card
  • Passport
  • Voter ID Card
  • Driving Licence

Address Proof (any one):

  • Aadhaar Card
  • Passport
  • Latest Utility Bill (not older than 3 months)
  • Bank Statement (not older than 3 months)
  • Registered Rent Agreement

Financial Proof:

  • Cancelled cheque or bank passbook copy
  • Latest bank statement (3 months)

5.3 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your account login credentials
  • All activities conducted through your account
  • Notifying the Company immediately of any unauthorised access or security breach
  • Keeping your registered email, phone number, and bank account details up to date

The Company will never ask for your password, OTP, or full bank account number through any communication channel. Never share these details with anyone — including individuals claiming to represent the Company.

5.4 One Account Per Investor

Each individual investor is permitted to hold only one registered account on the Platform. Creating multiple accounts by the same individual is strictly prohibited and may result in permanent account termination and forfeiture of all pending returns.

5.5 Account Verification Timeframe

KYC verification is typically completed within 24 to 48 working hours of submission of all required documents. The Company reserves the right to request additional documents or conduct enhanced due diligence at any stage.


6. INVESTMENT PLANS & TERMS

6.1 Nature of Investment Plans

Shree Moji Foundation offers structured micro finance Investment Plans under which investors contribute capital that is deployed into verified, high-impact projects in sectors including renewable energy, organic agriculture, digital education, healthcare technology, and community infrastructure.

6.2 Investment Plan Features

Each Investment Plan specifies the following at the time of subscription:

  • Minimum and maximum investment amount
  • Fixed annual return rate (expressed as percentage per annum)
  • Investment duration and lock-in period
  • Payout frequency (monthly or quarterly)
  • Early withdrawal terms and applicable charges
  • Project sector and fund deployment details

6.3 Minimum Investment Amount

The minimum investment amount is ₹500 for standard Investment Plans. Premium and long-term plans may have higher minimum investment thresholds as specified in the individual plan documentation.

6.4 Investment Confirmation

Upon successful payment, investors will receive:

  • An electronic investment confirmation certificate
  • A unique investment reference number
  • Fund deployment details and project allocation information
  • Scheduled payout dates for the duration of the plan

6.5 Returns on Investment

  • Returns are fixed as specified in each Investment Plan and are not subject to market fluctuations
  • Returns are calculated on the invested principal from the date of confirmed investment
  • Payout disbursements are made directly to the investor’s registered bank account on scheduled dates
  • The Company will deduct applicable TDS on returns as per the Income Tax Act, 1961, and issue Form 16A accordingly
  • Returns are subject to applicable taxes under Indian law and it is the investor’s responsibility to declare investment income in their Income Tax Return

6.6 Reinvestment Option

Upon maturity of an Investment Plan, investors may choose to reinvest their principal and accumulated returns into a new plan. Reinvestment instructions must be submitted at least 7 working days before the maturity date.

6.7 Plan Modification

The Company reserves the right to modify the terms of future Investment Plans at any time. However, any modifications will not affect plans already subscribed to by investors — those plans will continue under the original terms agreed at the time of subscription.


7. PAYMENTS & TRANSACTIONS

7.1 Accepted Payment Methods

Investments can be made through the following verified payment channels:

  • UPI (Google Pay, PhonePe, Paytm, BHIM)
  • Net Banking (all major Indian banks)
  • NEFT / RTGS / IMPS bank transfers
  • Debit Card (subject to transaction limits)

Cash deposits and third-party payments are strictly not accepted. All investments must be made from the investor’s own verified bank account linked to their registered KYC details.

7.2 Payment Processing

  • All payments are processed through PCI-DSS compliant, RBI-authorised payment gateway partners
  • Investment amounts are credited to the Company’s designated escrow account upon payment confirmation
  • The Company is not responsible for payment failures, delays, or errors caused by your bank or payment service provider
  • In case of a payment failure where funds are debited but investment is not confirmed, the amount will be automatically reversed to your source account within 5 to 7 working days
